Commercial debt recovery

 

Acting for a variety of companies we provide advice on and recover regulated and unregulated debt across a vast array of sectors, providing pre-litigation, litigation, and insolvency debt recovery services. Essentially if there is a debt, we will use our skills and experience to recover it for you - whether it’s from a company, sole trader, or consumer. 

 

The sectors we operate in include energy, water, insurance, retail, hospitality including events companies, financial services, wholesalers, recruitment, sports, student accommodation companies, commercial office management and letting companies, telephone/broadband services, bloodstock auction companies, private schools and colleges, and newspapers.

 

Recoveries services for clients include:

  • Monies outstanding in relation to invoices for goods sold and delivered
  • Monies outstanding in relation to services provided
  • Monies outstanding in relation to loans
  • Overpayments of salary/holiday pay
  • Return of equipment provided by employers
  • Recovery of personal expenditure where company credit cards have been abused
  • Pursuit of personal and company guarantors

We also advise on:

  • Collections and enforcement, including insolvency 
  • Documentation including terms and conditions, invoices, credit control letters 
  • New account documentation and processes, including due diligence requirements

We achieve the best outcomes for clients by:

  • Working with clients to understand any challenges within their business
  • Adopting a true partnership approach to ensure we conclude the vast majority of cases without proceeding to a trial
  • Being as aggressive or sensitive as necessary to ensure that, if our client wants to maintain the business relationship following the conclusion of the action, that customer is retained
  • Mitigating future risk by using the litigation process and settlement discussions as an opportunity to resolve any historic issues with documentation
  • Providing full training to your internal credit/accounts staff and sales teams where any risk is identified
  • Being fully transparent and providing online access to our systems so you can see in real time how cases are progressing
  • Using debtor profiling to identify appropriate cases to pursue or write off, ensuring there is no avoidable litigation, and no unnecessary costs 

 

 

Recent work undertaken by the team includes:

  • Successful pursuit of a defended winding up petition, the insolvency court allowing a trial, where a debtor had operated across the same sector under different company names and with different clients running up debt and trying to use bogus and fraudulent leases. We instructed IPs to pursue the director for misfeasance and he was subsequently imprisoned for fraud and money laundering.

  • Acting for a motor insurer, we successfully pursued full recovery of payment made to a third party where a policy had been voided, together with costs. The debtor unsuccessfully argued that our client had not secured a judgment before attempting to recover their outlay, and that they had failed to mitigate their losses by not arguing that the third party vehicle could have been repaired using cheaper parts.
  • Acting for an energy supplier where the debtor provided bogus leases placing the liability for energy supplied to an apartment with various tenants.  Working with our client’s fraud team we quickly identified the leases as fraudulent. By promptly commencing bankruptcy proceedings, the bankruptcy notice was placed on the property, stopping the sale, and our clients received payment in full and costs.

  • In a complex shipperless meter claim we worked with the network raising a theft in conveyance argument in conjunction with our client’s claim, rejecting an offer for 17% of the debt and securing a 90% recovery and costs.
