Football scouts are independent contractors, not employees

The Court of Appeal has unanimously held that a football club is not vicariously liable for sexual abuse committed by a scout because the scout was an independent contractor. Following Barclays Bank plc v Various Claimants [2020] UKSC 13 no vicarious liability can arise for the acts of a true independent contractor. On the facts, the complete absence of any control exercisable by the club over the scout was fundamental to the outcome.
