Recent successes

• Successful pursuit of a defended winding up petition, the insolvency court allowing a trial, where a debtor had operated across the same sector under different company names and with different clients running up debt and trying to use bogus and fraudulent leases. We then instructed IPs to pursue the director for misfeasance and he was subsequently imprisoned for fraud and money laundering.
• In a complex shipperless meter claim we worked with the network raising a theft in conveyance argument in conjunction with our client’s claim, rejecting an offer for 17% of the debt and securing a 90% recovery and costs.
• Acting for an energy supplier where the debtor provided bogus leases placing the liability for energy supplied to an apartment with various tenants, working with our client’s fraud team we quickly identified the leases as fraudulent. By promptly commencing bankruptcy proceedings, the bankruptcy notice was placed on the property stopping the sale with our clients receiving payment in full and costs.
• Acting for a motor insurer, we successfully pursued full recovery of payment made to a third party where a policy had been voided, together with costs. The debtor unsuccessfully argued that our client had not secured a judgment before attempting to recover their outlay, and that they had failed to mitigate their losses by not arguing that the third-party vehicle could have been repaired using cheaper parts.
