Based in our Southampton office, our disease team’s extensive experience dates back to Middleton v Elliot Turbo Machinery CA [1990] and includes Concept 70 v Cape Intermediate Holdings [2017]. They handle the full range of disease claim types and values, with a strategic approach to resolution in high value cases and an effective process driven approach to lower value claims.

Our proven success is based on working closely with our clients to identify at the earliest stage, cases either for settlement or to robustly defend.

We know that many low value disease claims fall outside the fixed costs regime and we always seek to manage the level of claimant costs.  We’re particularly focused on avoiding delay and inertia and we’re proactive when issuing applications to maintain control of the agenda.

Our collaborative approach means that we have good relationships with claimant lawyers and counsel instructed on their behalf.

We regularly resolve high value, complex or contribution claims between insurers as an alternative to trial or expensive and potentially brand-damaging public litigation.

Disease litigation is an ever-developing area and we stay in close contact with key organisations and working groups to stay at the cutting edge of new and developing trends.

As the industry develops processes to successfully repudiate traditional noise induced hearing loss (NIHL) claims across the board, we’re already seeing a new generation of noise claims, cavity wall-insulation linked respiratory claims and portable electronic device-related claims.
